This website (the “Website”) is operated by Awake.Net, Inc. (referred to as “Awake”, “us”, “we”, or “our” as the context may require). The information, products, and services provided on this Website are in furtherance of Awake’s purpose. Awake is a Delaware nonprofit in the process of applying for 501(c)(3).

Awake offers this Website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here (“you”, “your”, or “user”, as context may require, refer to you personally or, if using or registering with the Website on behalf of an organization, refer to the organization).

Please read these Terms of Service carefully before you start to use the Website. By using the Website or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms of Service. If you do not want to agree to these Terms of Service, you must not access or use the Website.

This Website is offered and available to users who are twenty-one (21) years of age or older. By using this Website, you represent and warrant that you are of legal age to form a binding contract with Awake and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

Disclaimer.

Nothing contained on this website is intended to encourage the use of illegal substances including Ayahuasca, Ibogaine, Cannabis or other psychedelic or psychoactive substances listed in the Schedules of the United States Controlled Substances Act. Under the federal laws of the United States of America, manufacturing, distributing, dispensing or possession of Scheduled substances is illegal without the proper license and authorization of from the Drug Enforcement Administration. Individuals are subject to arrest and prosecution based on their involvement with any scheduled substance including marijuana. 

We do not provide psychoactive or controlled substances. We do not provide referrals to “underground” (illegal) psychedelic services. Any information received through our services should be considered for educational purposes and not be misconstrued as medical or legal advice. Please use your discretion to ensure our services meet your needs.

Use of Website to sell, buy, distribute, receive, donate or otherwise transfer Scheduled substances, paraphernalia, or other drug-related products in is strictly prohibited.

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter.

We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason if all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users.

These Terms of Service permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Website. Awake reserves the right to delete or otherwise remove any User Contribution in its sole discretion.

Awake expressly disclaims all responsibility and endorsement and makes no representation as to the validity of any opinion, advice, information or statement made or displayed in these forums by third parties, nor are we responsible for any errors or omissions in such postings, or for hyperlinks embedded in any messages. Under no circumstances will we, our affiliates, suppliers or agents be liable for any loss or damage caused by your reliance on information obtained through these forums. The opinions expressed in these forums are solely the opinions of the participants, and do not reflect the opinions of Awake or any of its subsidiaries or affiliates.

Awake has no obligation whatsoever to monitor any of the content or postings on the message boards, chat rooms or other public forums on our websites. However, you acknowledge and agree that we have the absolute right to monitor the same at our sole discretion. In addition, we reserve the right to alter, edit, refuse to post or remove any postings or content, in whole or in part, for any reason and to disclose such materials and the circumstances surrounding their transmission to any third party in order to satisfy any applicable law, regulation, legal process or governmental request (national or international) and to protect ourselves, our clients, sponsors, users and visitors.

You agree to defend, indemnify, and hold harmless Awake, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Service or your use of the Website, including, but not limited to, your User Contributions, any use of the Website’s content, services, and products other than as expressly authorized in these Terms of Service, or your use of any information obtained from the Website.

Governing Law and Jurisdiction

All matters relating to the Website and these Terms of Service, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Delaware without giving effect to any choice or conflict of law provision or rule (whether of the State of Delaware or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Website shall be instituted exclusively in the courts of the State of Delaware although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Service in your country of residence or any other relevant country. Arbitration

At Awake’s sole discretion, it may require you to submit any disputes arising from these Terms of Service or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Delaware law.

Waiver and Severability

No waiver by Awake of any term or condition set out in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Awake to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
